Bridging Visas: Your Path to Continued Stay in Australia
When studying in Australia, having the correct visa is essential. A Bridging Visa allows you to “bridge” the gap between an expired visa and the one you are currently applying for. Essentially, this is a temporary visa that allows you to legally remain in Australia while your substantive visa application is being processed.
Bridging visas are temporary permits given to individuals lawfully present in Australia while they wait for a decision on a new visa application.
They function as a transition between your current visa and the visa you are applying for.
These visas ensure that you can stay in Australia legally without violating visa conditions while your substantive visa is under review.
Bridging visas can serve various purposes, including:
If your original visa has expired and you are waiting for your substantive visa to be approved,
If you are awaiting a court decision regarding a visa appeal,
If you are awaiting a decision from the Administrative Appeals Tribunal after a visa refusal or cancellation,
If you have requested Ministerial Intervention, or
If you are unlawfully in Australia but are arranging to leave voluntarily.
If you are currently on a substantive Australian visa and apply for another substantive visa, you will be granted a Bridging Visa A (BVA). This visa allows you to stay legally in Australia while your new application is being processed.
Key points about the BVA:
Travel Rights:
A BVA does not grant travel rights. If you leave Australia while on this visa, you won’t be able to return. However, you can apply for a Bridging Visa B (BVB), which allows travel.
If you travel on your current substantive visa after submitting another visa application, your BVA will end when you leave Australia. You’ll need to reapply for the BVA upon your return. If your BVA isn’t reinstated before your current visa expires, you could become unlawful.
Work Rights:
Generally, the BVA does not come with work rights unless you apply to the Department for a BVA with no work restrictions. To do this, you usually need to show that you are experiencing financial hardship.
If you have been nominated or sponsored by an employer for a substantive skilled visa, and you meet the requirements, work rights will automatically be included with the BVA.
If you are applying for an onshore partner visa (Subclass 820), you will automatically receive work rights while your application is being processed.
What is the bridging visa B in Australia?
The Subclass 020, also known as the Bridging Visa B (BVB), is a temporary visa that allows you to leave and return to Australia while waiting for a decision on your substantive visa application. Similar to the Bridging Visa A (BVA), the BVB permits you to stay in Australia during the processing of your substantive visa. However, the Subclass 020 is the only bridging visa that grants travel rights outside Australia while your substantive visa is under review. If you depart Australia on any other type of bridging visa, it will be canceled upon leaving, preventing your return.
